A Boulder judge has recently ruled against the enforcement of a local ban on assault weapons and large-capacity magazines, a decision that comes in the wake of a tragic mass shooting in the city. The ban was initially put in place in 2018 after the devastating school shooting in Parkland, Florida.
Earlier this month, District Judge Andrew Hartman determined that a 2003 Colorado state law prohibits cities and counties from enacting restrictions on firearms that are already legal under federal and state regulations. Hartman emphasized the importance of statewide uniformity in gun regulations, suggesting that Boulder’s local ordinance could prompt other cities in Colorado to pursue similar bans.

The original 2018 ban prohibited the possession, transfer, and sale of certain shotguns, pistols, and semiautomatic rifles, along with large-capacity magazines, defined as those holding more than 10 rounds. A permit system was also established for individuals who had previously owned these firearms.
Following the judge’s ruling, Boulder city officials directed police to cease enforcement of the ban, coinciding with a mass shooting in a Boulder grocery store that left 10 people dead on March 22.
State Representative Tom Sullivan, who has been an advocate for stricter gun control following the loss of his son in the Aurora theater shooting, remarked on the role of assault weapons in increasing the lethality of mass shootings.
